IMPORTANT: PLEASE READ CAREFULLY

By downloading, installing, or using the Relieved app or website, or by completing a guest checkout, you agree to be bound by these Terms and Conditions. If you do not agree, you may not use the Platform or any of our services.

1. About Relieved and These Terms

These Terms and Conditions ('Terms') govern your use of the Relieved mobile application, website, and related services (collectively, the 'Platform'), operated by REBA Software, a sole proprietorship (eenmanszaak) registered in the Netherlands.

Operator details:

These Terms apply to all users of the Platform, including seekers (users who book toilet access), hosts (individuals or businesses who offer toilet facilities), and guest users (who book without an account). At present the Platform admits business hosts only; private individuals can join a waiting list.

2. Relieved Is a Marketplace, Not a Service Provider

THIS IS THE MOST IMPORTANT SECTION OF THESE TERMS. PLEASE READ IT CAREFULLY.

Relieved provides a digital marketplace and payment-facilitation technology platform that connects seekers who need toilet access with hosts who offer their facilities. Relieved does not own, operate, control, clean, inspect, or guarantee any host location or toilet facility listed on the Platform.

When you complete a booking through the Platform, a direct legal contract is formed between the seeker and the host. Relieved is not a party to that contract. All rights and obligations arising from the toilet access visit are between the seeker and the host.

Relieved does not:

In short: Relieved connects two parties and facilitates the payment. The service itself is provided by the host at their own premises.

3. Eligibility, Accounts, and Guest Use

3.1 Age requirement

You must be at least 18 years of age to use the Platform. By using the Platform, creating an account, or completing a guest checkout, you represent and warrant that you are 18 or older. If you are under 18, you may not use the Platform.

3.2 An account is optional

You do not need an account to use Relieved. You may book and pay for a toilet visit as a guest via the Relieved website (see Section 4.6). Creating an account is optional and gives you a lower per-visit price, a prepaid Relieved Credit balance, reviews, and other Platform features. If you create an account, you must provide accurate, complete, and current information and keep your credentials confidential.

3.3 One account per person

Each person may hold only one account. Creating multiple accounts is prohibited and may result in immediate termination of all associated accounts.

3.4 Account and credential security

You are solely responsible for all activity that occurs under your account. You must use a sufficiently strong password, keep your login credentials (including any two-factor codes) strictly confidential, and not share, sell, or transfer access to your account to anyone. You must notify us immediately at support@relievedapp.com if you suspect any unauthorised use of your account. Relieved is not liable for loss caused by unauthorised use of your account that occurs before you notify us, unless that use is attributable to Relieved.

3.5 Acceptance of these Terms

These Terms are binding only if they have been made available to you before you agree to them. When you register, you must actively tick a checkbox confirming that you are 18 or older and that you have read and accept these Terms and our Privacy Policy. For guest checkout, you must confirm the same before payment is processed. For material changes, you will be asked to re-confirm. These Terms are available at all times at relievedapp.com/terms. Under Dutch law (Article 6:234 BW), general terms are binding only where the other party had a reasonable opportunity to read them before or at the time of contracting.

4. How the Platform Works

4.1 For Seekers

Seekers may browse available host locations on the map, view facility information, and book a toilet visit. Payment is made using Relieved Credit (see Section 5), by direct payment from your account, or, without an account, via guest checkout (see Section 4.6). Upon confirmed booking, the seeker may visit the host location within the agreed time window.

4.2 For Hosts

Hosts may list their toilet facility on the Platform by providing accurate information about the location, facilities, opening hours, and price per visit. Hosts set their own visit price and availability within the parameters set by Relieved. Additional terms that apply specifically to hosts are set out in the Host Addendum at the end of these Terms.

4.3 Pricing and fees

The price a seeker pays for a visit is the visit price the host has set for their toilet. That visit price includes Relieved's platform commission (€0.50 per visit; for toilets in another currency, the fixed amount in that currency shown at sign-up and in the host dashboard, in Hungary 190 Ft), which the host owes to Relieved and which Relieved retains; the seeker pays nothing separately for it. Where the visit is paid without a prepaid Relieved Credit balance (guest checkout or direct payment), a guest fee of €0.35 per visit is added, which the seeker pays to Relieved. All amounts, and the resulting total, are shown transparently before you confirm and pay. Paying from a prepaid Relieved Credit balance is therefore cheaper per visit than paying without a balance, because the guest fee does not apply. Amounts may vary by currency; the applicable amounts are always displayed before payment.

> Prices are shown inclusive of any applicable VAT. The make-up of the total (the host's visit price and any guest fee) is itemised before you confirm your booking, in accordance with EU consumer law.

4.4 Booking confirmation

A booking is confirmed when the Platform issues a booking confirmation to you (in the app, on the website, or by email). Only confirmed bookings grant the seeker the right to access the host location. The service is performed immediately upon confirmation: your one-time access code is issued at once.

4.5 Cancellation Policy

Bookings at hosts listed on the Platform are confirmed instantly. After you confirm a booking, you receive your access code immediately and the contract is performed as described in Section 6: at your express request the service starts at once, and the service consists of making the toilet available to you during the access window stated at booking.

Free cancellation as a courtesy. As a courtesy, you may cancel a booking free of charge within two minutes of confirming it, provided the access code has not been used; the full amount is then returned to the payment method you paid with, and to your Credit balance if you paid with Credit. This courtesy is not a contractual right. If you cancel within that window three times in thirty days, a member of our team may suspend the courtesy for ninety days; if that happens, you will see it before you pay. Your ticket and your statutory rights are not affected by the courtesy or its suspension.

Host closed or inaccessible. Where a host is listed as available but is in fact closed or inaccessible on arrival, the service has not been performed and you are entitled to a full refund. Please report this to support@relievedapp.com. Reporting promptly helps us verify the claim quickly on the available evidence (booking timestamps and the host's availability records), but a later report does not remove your right to a refund. We assess each claim on the evidence and give you our reasons; where we decline a refund, the burden of establishing that the service was in fact performed, or that the refund is otherwise not due, rests with Relieved. If you disagree with our assessment, you may challenge it through our reporting and complaints procedure (Section 17), through an out-of-court dispute resolution body (Section 20.4), or the courts, in accordance with Section 20.

This cancellation policy operates alongside, and does not limit, your statutory right of withdrawal described in Section 6.

4.6 Guest Checkout: Visiting Without an Account

Guest checkout is available via the Relieved website (relievedapp.com). The guest pays the host's listed visit price (which includes the platform commission, Section 4.3) plus the €0.35 guest fee, all shown transparently before payment. Upon successful payment, the guest receives a one-time access code valid for a limited time. No Relieved Credit is created or stored; the payment covers one visit only. Guest users are subject to the same conduct obligations as account holders (Section 7). Personal data provided during guest checkout is used solely to process the transaction, in accordance with our Privacy Policy.

4.7 Time of Performance and Statutory Remedies

We perform our service immediately: your booking is processed at once and the one-time access code is issued upon confirmation. If we fail to perform on time, you may require us to perform within a reasonable additional period, and you may terminate the contract if we still fail to perform within that period; you may terminate immediately where timely performance was essential for you or where we refuse to perform. Upon termination, we refund all sums paid without undue delay and at the latest within 14 days. Where the mandatory law of your country provides stronger remedies or statutory increases for late refunds (for example Articles L.216-1 to L.216-6 and L.241-4 of the French Consumer Code, under which late refunds are increased by 10, 20, or 50 percent depending on the delay), those provisions apply. This Section states statutory minimum rights and, where more favourable to you, prevails over Section 4.5.

5. Relieved Credit and Payments

5.1 What is Relieved Credit

Relieved Credit ('Credit') is a prepaid balance held in your Relieved account that you use to pay for toilet visits on the Platform. Credit is not cash, is not a gift card, and is not legal tender; however, purchased Credit can at all times be redeemed at its full (par) value as set out in Section 5.6.

5.2 Loading Credit

You may load Credit via the Platform using the available payment methods. The minimum top-up is EUR 5.00 and the maximum top-up is EUR 200.00, or the equivalent in your currency. Relieved Credit is a prepayment for future bookings on the Platform: it is not electronic money and not a payment instrument, and it can only be used to pay for visits at Hosts listed on the Platform, which places it within the limited network exemption in Article 3(k) of Directive (EU) 2015/2366. REBA Software administers your Credit balance and is the party that owes it to you. Payments are processed by Stripe Technology Europe, Limited, an authorised payment institution licensed by the Central Bank of Ireland, under its own terms. We keep funds corresponding to outstanding purchased Credit available at all times so that we can repay it on request.

5.3 Use of Credit

Credit may only be used to pay for toilet visits booked through the Relieved Platform. Credit cannot be used to purchase any other goods, digital content, subscriptions, or services.

5.4 Platform commission

Relieved retains a platform commission of €0.50 per confirmed visit (or the fixed amount in the toilet's currency, Section 4.3) from every visit price. That commission is a fee owed by the host to Relieved and is not charged to you separately: at booking, only the visit price is deducted, plus the guest fee where you pay without a balance (Section 4.3). Hosts receive their share of each visit price via Stripe Connect (see the Host Addendum).

5.5 Currency and exchange rate

Relieved is priced in euro (EUR) as its base currency. You may choose a different display and payment currency in your profile. Where you pay in a currency other than the toilet's currency, Relieved converts the price at the European Central Bank reference rate plus 4 percent; that mark-up is a charge retained by Relieved and is disclosed to you: the rate, the mark-up, and the resulting total are always shown before you confirm and pay. You can always pay in the toilet's currency instead, in which case your own bank sets the conversion. Refunds are made in the currency and amount you actually paid. Choosing a currency is optional and is your decision; you may always pay in the base currency instead. Your payment processor (Stripe) may apply its own separate conversion where relevant.

> Your Relieved Credit balance is held in the currency of your first top-up; that currency is then fixed. If you change your display currency, the currency of your balance does not change and you can spend it at its full value in that currency; if you want Credit in another currency, you spend your balance or have it repaid (Section 5.6). A top-up in a currency other than that of your balance is not added to your balance but set aside; you then receive an email in which you choose between repayment to your original payment method and conversion into the currency of your balance at the European Central Bank reference rate without any mark-up. We never convert your existing balance or apply any mark-up to Credit already loaded.

5.6 Refunds and redemption of Credit

You can ask us to repay your unspent purchased Credit at its full (par) value at any time, and we will do so free of charge. This right is contractual and permanent: it is not limited to any withdrawal or cooling-off period, purchased Credit never expires, and nothing in these Terms limits, delays or removes it. We repay to the payment method you used where possible, or otherwise to a bank account you provide, normally within 14 days of your request.

Promotional Credit (bonuses, referral rewards, and goodwill gestures that you did not pay for) is not purchased Credit, has no repayment value, and is non-refundable and may expire. Where your balance contains both purchased and promotional Credit, promotional Credit is used first.

5.7 Inactivity

Your purchased Credit does not expire. If your account has had no activity (no top-ups, bookings, or logins) for 3 consecutive years, we will contact you by email at your registered address to ask whether you wish to continue using the Platform or redeem your balance. Your right to redeem your purchased Credit at par value survives any period of inactivity. Promotional Credit may expire after 3 years of inactivity following written notice.

5.8 Credit when you delete your account

When you request account deletion, the Platform first shows your current Credit balance and what still needs to be settled before you confirm.

If you still hold purchased Credit, your account is deleted after that Credit has been repaid to you: you request the repayment (from your profile once that function is available, and until then via support@relievedapp.com), we carry it out within 14 days to your original payment method, and your account is then erased. A visit in progress, a pending refund, a top-up set aside (Section 5.5), or a pending payout is likewise completed first. Promotional Credit is forfeited. Deleting your account never causes you to lose the value of Credit you have paid for; your right to erasure under GDPR Article 17 is not limited by this, only carried out after we have returned your money. We retain the minimum transaction records required by law (see our Privacy Policy) in reliance on Article 17(3) GDPR.

5.9 Fraud and misuse

Relieved may cancel, void, or reverse any Credit obtained by fraud, misrepresentation, chargebacks, abuse of a referral programme, or other misuse, and may close the account concerned.

5.10 Non-transferable

Credit is personal to your account and may not be transferred to another user, sold, or assigned.

6. Right of Withdrawal (Consumers)

If you are a consumer in the EU/EEA (or a jurisdiction with equivalent rules), you normally have the right to withdraw from a distance contract within 14 days without giving a reason. This Section explains how that right applies to toilet visits and top-ups, and where you can find the electronic withdrawal function ("withdrawal button") on our website.

6.1 Immediate performance and loss of the withdrawal right

A toilet visit is a service that is performed immediately, at your request. Before you confirm a booking, you expressly request that performance begins at once and you acknowledge that, once the service has been fully performed, you lose your right of withdrawal. You provide this consent by ticking the confirmation box (or its equivalent) shown at booking. Once the visit has been fully performed, the right of withdrawal no longer applies (in line with Article 16(a) of Directive 2011/83/EU and its national implementations).

After each booking, we provide you with confirmation on a durable medium (by email or within the app) that records your express request for immediate performance and your acknowledgment that the right of withdrawal is lost once the service has been fully performed, in accordance with Articles 7 and 8 of Directive 2011/83/EU.

Where the Platform allows you to book a visit for a future time slot, your right of withdrawal continues to exist until the service has been performed. You may exercise it free of charge at any time before the visit, using the withdrawal function described in Section 6.3 or by contacting support@relievedapp.com.

6.2 Top-ups (Relieved Credit)

Loading Relieved Credit is a separate transaction from booking a visit, and it is subject to the statutory right of withdrawal. You may withdraw from a top-up within fourteen days of the top-up without giving any reason, using the withdrawal function on relievedapp.com (Section 6.3), the model withdrawal form, or any other unequivocal statement to support@relievedapp.com. We then repay the part of that top-up you have not spent within fourteen days, using your original payment method; Credit already spent on visits is deducted. Independently of this right, purchased Credit never expires and can be repaid to you at its full value at any time, free of charge (Section 5.6).

6.3 The withdrawal function ("withdrawal button")

In accordance with Directive (EU) 2023/2673 and its national implementations (including Article 6:230oa of the Dutch Civil Code, §356a of the German Civil Code, and Articles L.221-21 and D.221-5 of the French Consumer Code), an electronic withdrawal function is available on our website for every distance contract that carries a withdrawal right. You can find it at all times via the footer of every page of relievedapp.com, without having to log in. It is a clearly labelled two-step function: a withdrawal button (labelled, depending on your language, "Withdraw from contract here", "Vertrag widerrufen", "renoncer au contrat ici", "recedere dal contratto qui", "desistir del contrato aquí", "overeenkomst hier herroepen", or "elállás a szerződéstől"), followed by a separate confirmation step (labelled, depending on your language, "confirm withdrawal", "herroeping bevestigen", "confirmer la rétractation", "Widerruf bestätigen", "confirmar el desistimiento", "conferma recesso", or "elállás megerősítése"). It is available throughout any applicable withdrawal period. When you use it, we confirm receipt of your withdrawal without delay on a durable medium, recording its content and the date and time it was received.

The function is relevant to top-ups (where it routes to redemption of unused Credit, Section 6.2) and to bookings for a future time slot (Section 6.1). It is also available for guest bookings, using your booking code and the email address of your confirmation. It no longer applies to a visit that has already been fully performed with your express consent, because the withdrawal right has then ended. In certain countries (including France, Germany, Spain, and Italy), the confirmation of immediate performance and loss of the withdrawal right is presented to you at each booking in your country's required form. Your mandatory statutory rights as a consumer in your country of residence always apply, regardless of the governing law in Section 20.

A model withdrawal form (Annex I(B) of Directive 2011/83/EU) is available at relievedapp.com; you may also withdraw by any other unequivocal statement, for example by emailing support@relievedapp.com.

7. Seeker Obligations

As a seeker (whether an account holder or guest), you agree to:

You are responsible for the conduct and safety of any minor you bring with you. In a medical emergency, contact local emergency services immediately (112 throughout the EU). If you damage a host's property, or take or remove any item that is not yours, you are personally and solely liable for the reasonable cost of repair, replacement, or return. Any claim by a host for damage or theft is against you directly; REBA Software is not a party to and bears no responsibility for such claims.

If you believe a host has refused you access or treated you differently on a discriminatory ground (Section 16), please report it via the app or support@relievedapp.com; we treat such reports under Section 17 and may suspend or remove the host.

8. Privacy, Recording, and Prohibited Surveillance

THIS SECTION IS STRICTLY ENFORCED. VIOLATIONS RESULT IN AN IMMEDIATE AND PERMANENT BAN.

8.1 Absolute prohibition on recording devices

Hosts must not install, operate, conceal, or permit any camera, microphone, recording device, two-way mirror, or any other surveillance or image- or sound-capturing equipment in, or with a view into, any toilet, bathroom, changing area, or other space a seeker uses or could reasonably expect to be private. This prohibition is absolute and applies whether or not the device is recording, active, or connected. Any device capable of capturing images or sound in such a space is prohibited even if switched off.

8.2 Seeker privacy

Every seeker has an absolute right to privacy during a visit. No user may photograph, film, record, livestream, or otherwise capture another person in or around a host location without that person's explicit, freely given consent. Covert recording of any person is strictly prohibited.

8.3 Immediate ban and reporting to authorities

Any host found to have installed or operated prohibited surveillance, or to have covertly recorded a seeker, will have their account and all listings permanently terminated immediately and without refund. Relieved will preserve relevant evidence and, in accordance with Article 18 of Regulation (EU) 2022/2065 (the Digital Services Act), will promptly inform the competent law-enforcement or judicial authorities where it becomes aware of information giving rise to a suspicion that a criminal offence involving a threat to the life or safety of a person has taken place, is taking place, or is likely to take place. Relieved will also notify the competent data-protection authority and will cooperate fully with any investigation. Covert recording in a private space is a serious criminal offence in every country in which Relieved operates.

8.4 Host indemnity for privacy violations

A host who breaches this Section agrees to fully indemnify and hold harmless REBA Software against all claims, damages, penalties, and costs (including all legal defence costs and any compensation payable to affected seekers) arising from that breach. This indemnity is in addition to, and does not limit, the general host indemnity in the Host Addendum. Nothing in these Terms limits a seeker's right to pursue the offending host directly, or to pursue any remedy available under applicable criminal or data-protection law.

8.5 Reporting a suspected violation

If you see or suspect any recording device or privacy violation at a host location, leave if you feel unsafe, contact local law enforcement where appropriate, and report it to Relieved immediately at support@relievedapp.com. Relieved will act without undue delay in accordance with Section 17 (Reporting and Content Moderation).

9. Health, Hygiene, and Illness Claims

The host is solely responsible for maintaining the hygiene, cleanliness, and sanitary condition of their facility (see the Host Addendum). REBA Software does not clean, inspect, or guarantee the sanitary condition of any host location and gives no warranty as to hygiene. Any claim that a seeker has suffered illness, infection, or harm arising from the sanitary condition of a facility is a matter between the seeker and the host, and any such claim must be pursued against the host directly. This Section does not exclude REBA Software's liability for death or personal injury caused by its own negligence, which cannot be excluded under applicable law.

10. Reviews

Reviews must be genuine, relevant, and based on the reviewer's actual experience. Only users who have completed a visit may review it; Relieved discloses this verification in line with the EU Omnibus Directive. Fake, incentivised, or retaliatory reviews are prohibited. Relieved may remove reviews that breach these Terms but will not remove negative reviews merely because the reviewed party disagrees. By submitting a review or other content, you grant REBA Software a non-exclusive, worldwide, royalty-free, sublicensable licence to use, reproduce, adapt for formatting and excerpting, and display it to operate and promote the Platform.

For each published review we display the date of publication and the date of the visit to which it relates. Reviews are shown in chronological order, most recent first. We do not offer or provide any payment or other benefit in exchange for submitting a review. A review remains published for as long as the relevant listing is available on the Platform and is removed or anonymised when the listing or the reviewer's account is deleted. If we decline to publish or remove your review, we will inform you of the reasons by appropriate means.

A review is not published immediately: it becomes visible once both parties have submitted their review or, if the other party does not submit one, fourteen days after the first submission; until then it remains hidden. This does not shorten the 30-day window for submitting a review; a review submitted after the other party’s review has become visible is published upon submission.

A review can be submitted within 30 days of the visit it concerns. For Hosts in the restaurant, hospitality or tourism sector in Italy, Italian law (Law No. 34 of 11 March 2026) additionally requires that a review reflects a genuine personal experience, is relevant to the service reviewed and is not given in exchange for any payment, discount or other benefit. Reviews that no longer meet the requirements of that law, including after the two-year period it provides, may be removed.

11. Intellectual Property

The Relieved Platform, including its software, design, trademarks, trade names, logos, and all content created by REBA Software, is owned by or licensed to REBA Software. 'Relieved' is the subject of Benelux trademark filing no. 1546513 (classes 9 and 42). The Platform incorporates open-source components; the applicable licence notices are available on request via support@relievedapp.com and, in the app, under Settings > About > Licences. REBA Software grants you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for personal, non-commercial use. You may not copy, modify, reverse-engineer, resell, or use the Platform to build a competing service.

12. Disclaimer and Limitation of Liability

THE PLATFORM IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTY OF ANY KIND. REBA SOFTWARE DOES NOT GUARANTEE THE QUALITY, SUITABILITY, SAFETY, HYGIENE, CLEANLINESS, ACCESSIBILITY, OR CONDITION OF ANY HOST LOCATION. RELIEVED DOES NOT PROVIDE ANY INSURANCE COVERING VISITS, HOSTS, OR SEEKERS.

REBA Software is not a party to the contract between seeker and host; any remedy for harm caused by a host or host location must be pursued against that host directly.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REBA Software's liability to you is limited to reasonably foreseeable direct loss arising from a breach of these Terms. REBA Software is not liable for loss that was not reasonably foreseeable, nor for indirect or consequential loss (such as loss of profits, loss of data, or loss of goodwill).

Where REBA Software breaches an essential contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely), REBA Software is liable for the foreseeable loss typical for this type of contract, even where the limitation above would otherwise apply; for breach of non-essential obligations, liability for slight negligence is excluded to the extent permitted by law.

Nothing in these Terms excludes or limits REBA Software's liability for: death or personal injury caused by REBA Software's own negligence; fraud or fraudulent misrepresentation; intent or conscious recklessness (opzet of bewuste roekeloosheid); gross negligence; liability under mandatory product-liability law; or any other liability that cannot be excluded or limited under applicable law. Your statutory rights as a consumer under Dutch and EU law, and under the mandatory law of your country of residence, are not affected by these Terms. Where any limitation in these Terms is found to be unenforceable against you as a consumer, the remaining provisions continue to apply and your mandatory statutory rights prevail.

13. Force Majeure

REBA Software is not liable for any delay or failure resulting from circumstances beyond its reasonable control, including natural disasters, pandemics, wars, government actions, or failures of third-party services (including Stripe, Supabase, or Mapbox) that REBA Software could not reasonably prevent or remedy.

14. Account Suspension and Termination

14.1 Termination by you

You may delete your account at any time via Profile > Settings > Delete Account, subject to the Credit rules in Section 5.8. Deletion is processed in accordance with GDPR Article 17.

14.2 Termination by Relieved without cause

Relieved may terminate your account without cause by giving you 21 days' notice by email. During this period your account remains active and you may use your Credit. At the end of the notice period, any unspent purchased Credit is redeemed and returned to you via Stripe. Promotional Credit expires.

14.3 Immediate suspension or termination

Relieved may immediately suspend or terminate your account, without notice, if you materially breach these Terms, commit fraud or misuse, create a safety or health risk, violate applicable law, repeatedly fail to honour bookings, or where required by law or court order. On suspension or termination for breach, promotional Credit is forfeited and Relieved may suspend your access to the Platform. Your right to redeem unspent purchased Credit at par value is unaffected, save that Relieved and Stripe may withhold redemption of any Credit obtained by fraud, chargeback abuse, or other unlawful means, pending investigation and in accordance with applicable law.

15. Changes to These Terms

We may update these Terms. Non-material changes take effect 7 days after notification. Material changes are notified at least 21 days before they take effect and, where required by law or appropriate, you will be asked to actively re-confirm your acceptance. If you do not agree with a material change, you may delete your account before the effective date; if you continue to use the Platform after the effective date, the updated Terms apply.

16. Prohibited Conduct and Non-Discrimination

You agree not to: use the Platform unlawfully; impersonate any person or entity; harass, threaten, or harm other users; manipulate reviews or rankings; create false bookings or abuse the cancellation system; circumvent security or access controls; scrape or extract data without written permission; advertise third-party products; or disrupt the Platform or its networks.

Anti-circumvention. You may not use the Platform to identify a host or seeker and then complete, pay for, or solicit the same or a substitute toilet-access transaction outside the Platform in order to avoid the platform commission or guest fee. Hosts may not ask seekers to pay outside the Platform for a visit initiated through it, and may not charge a seeker more on site than the price confirmed at booking. Circumvention is a material breach and a ground for suspension or termination.

Non-discrimination. Relieved is built on the idea that everyone needs access to a toilet. Hosts may not refuse access to, impose different conditions on, or otherwise treat a seeker with a confirmed booking less favourably because of race, colour, ethnic or national origin, religion or belief, gender, gender identity or expression, sexual orientation, disability, chronic illness, pregnancy, age, or nationality. Objective, non-discriminatory house rules (for example a maximum number of people) remain permitted. Discriminatory conduct is a material breach: seekers can report it (Section 7 and Section 17), and Relieved may suspend or permanently remove the host, in line with the Dutch Equal Treatment Act (Algemene wet gelijke behandeling) and equivalent law in the host's country.

17. Reporting and Content Moderation

You may report users, listings, or reviews via the app or support@relievedapp.com. Relieved reviews reports in a timely, diligent, non-arbitrary, and objective manner and may issue warnings, suspend or terminate accounts, or remove content, consistent with Regulation (EU) 2022/2065 (the Digital Services Act). Where Relieved restricts content or an account, it provides the affected user with a clear and specific statement of reasons, unless prohibited by law.

Misuse of the reporting system. Submitting false, deliberately misleading, or manifestly unfounded reports is a breach of these Terms. Where a user frequently submits manifestly unfounded reports, Relieved may, after issuing a prior warning, suspend for a reasonable period the processing of further reports from that user, in line with Article 23 of the Digital Services Act. The same applies to the frequent submission of manifestly unfounded complaints.

Nothing in this Section limits your right to report suspected illegal content or conduct directly to the competent authorities, for example, in France, via the official PHAROS reporting platform (internet-signalement.gouv.fr).

18. Disputes Between Users

Disputes arising from a toilet visit (condition of the facility, refusal of access, damage) are between the seeker and the host. Relieved is not obliged to mediate but may do so at its discretion as a goodwill gesture; any such goodwill decision is not a binding legal determination.

19. Privacy

Your use of the Platform is also governed by our Privacy Policy at relievedapp.com/privacy. By using the Platform, you confirm you have read and understood it. You have the right to access your personal data and to receive a copy of it in a structured, commonly used, machine-readable format (data portability) under Articles 15 and 20 GDPR. You may exercise this by contacting support@relievedapp.com, or, where available, by using the data-export function in Profile > Settings.

20. General Provisions, Governing Law, and Dispute Resolution

20.1 Entire agreement, severability, waiver, assignment

These Terms, with the Privacy Policy and the Host Addendum, are the entire agreement between you and REBA Software. If any provision is invalid, the rest remain in force. Failure to enforce a provision is not a waiver. You may not assign your rights without our consent; REBA Software may assign in connection with a merger, acquisition, or sale of assets. We will notify you of any such assignment, and it will not reduce your rights under these Terms. In case of conflict, specific information given to you at booking (price, access method, access window) prevails over general descriptions in these Terms, and the Host Addendum prevails over these Terms only as regards the host relationship.

20.2 Language

These Terms are drafted in English. Official translations are available for certain countries at relievedapp.com/voorwaarden (Dutch), /conditions (French), /terminos (Spanish), /termini (Italian), /agb (German), and /aszf (Hungarian). If you are a consumer and you entered into the contract on the basis of a translated version, that translated version governs your contract with us. The English version governs only where no translation exists for your language, and in the relationship between REBA Software and Business Hosts. In all cases the mandatory consumer-protection law of your country of residence prevails.

20.3 Governing law and jurisdiction

These Terms are governed by Dutch law. If you are a consumer, this choice of law does not deprive you of the protection of the provisions of the law of the country of your habitual residence that cannot be derogated from by agreement (Article 6(2) of Regulation (EC) No 593/2008, Rome I): those mandatory provisions always apply in addition.

If you are a consumer, you may bring legal proceedings against REBA Software either in the courts of your own country of residence or in the courts of the Netherlands. REBA Software will bring proceedings against a consumer only in the courts of the country where the consumer resides. Nothing in this Section limits any mandatory jurisdiction rule that applies for your benefit. For Business Hosts, the exclusive jurisdiction of the courts of Amsterdam applies as set out in Section H10 of the Host Addendum.

20.4 Out-of-court dispute resolution (ADR)

If you have a complaint, please contact us first at support@relievedapp.com with a description of the issue and your booking reference; we confirm receipt, investigate, and reply with our reasons within 30 days. We do not subscribe to any code of conduct. If we cannot resolve your complaint, you may be able to use an out-of-court dispute resolution body:

20.5 Notices

We may give you notices under these Terms by email to the address registered on your account, by in-app notification, or both. A notice sent by email is deemed received on the day of transmission (or the next business day where sent outside business hours), provided we have no delivery failure. You are responsible for keeping your registered email address current. You may give us notice by email to support@relievedapp.com; your notice is effective on our confirmation of receipt or, at the latest, one business day after transmission without a delivery failure.

20.6 Contact

21. Further provisions

21.1 Manifest errors. Where a displayed price or amount is a manifest error that you could reasonably recognise as such (for example a visit shown at zero, or at a small fraction of the host's listed price because of a technical fault), we may cancel the booking before performance and refund the full amount. If an error means you were charged more than the price shown to you, we refund the difference.

21.2 Rounding and currency. Amounts are shown and charged in the unit customary for the currency (for example whole forints). Where a currency conversion applies, the rate and margin shown to you before payment govern (Section 5).

21.3 One code, one visit. An access code is for a single visit by a single person, unless the host indicates otherwise. A small child in your care may accompany you.

21.4 Automated access. You may not use bots, scrapers, or other automated tools to access the Platform, create accounts, or make bookings. Ordinary search-engine indexing of public pages is permitted.

21.5 Feedback. Suggestions and feedback you send us may be used freely, without any obligation or compensation to you.

21.6 Changes to the service. We may change, add, or discontinue features of the Platform; where a change materially affects you, we give reasonable notice. Changes to these Terms follow Section 15. If we discontinue the Platform altogether, we give at least 30 days' notice and repay all unspent purchased Credit.

21.7 Devices and connectivity. The Platform depends on your device, your internet connection, and your device's location services. We are not responsible for their availability or accuracy. A visit you have already paid for is not affected by a device problem on your side; if you cannot see your access code, contact support@relievedapp.com.

21.8 Marks and domains. Relieved, the Relieved logo, and the domain relievedapp.com identify REBA Software. You may not use them, or confusingly similar signs or domains, without our written permission.

21.9 Insolvency. Your Credit balance and the amounts we hold for payment to hosts are claims against REBA Software; they are not held in a separate protected account. In the unlikely event of REBA Software's insolvency, you would rank as an ordinary creditor for those amounts. We keep funds corresponding to outstanding purchased Credit available at all times (Section 5).

21.10 Survival. Provisions that by their nature are meant to continue after the termination of your account or of these Terms (including data retention, limitations of liability, intellectual property, dispute resolution, and the repayment of purchased Credit) continue to apply.

HOST ADDENDUM: ADDITIONAL TERMS FOR HOSTS

This Host Addendum applies in addition to the main Terms whenever you list or operate a toilet facility as a host. Where this Addendum conflicts with the main Terms in respect of hosting, this Addendum prevails. By listing a facility, you accept this Addendum.

H1. Host Status and Relationship

You list and operate your facility as an independent party, not as an employee, agent, or partner of REBA Software. You are solely responsible for your facility, your compliance with law, and your tax affairs. The contract for each visit is between you and the seeker; Relieved is only the intermediary and payment facilitator. Relieved collects the visit price from the seeker in your name and on your behalf, as your disclosed collection agent, and pays it out to you net of the platform commission; Relieved does not purchase or resell your service, and you always set your own price (Section H6). This authorisation covers all toilets you have listed under your business. You are the provider of the toilet service to the seeker and you fulfil yourself, in your own name, every receipt and invoice obligation that the law of your country attaches to a visit (in Hungary the nyugta or számla, Áfa tv. Sections 159 to 176), using your own cash register or receipt system, at the moment of the code check and for the visit price; if the seeker asks for an invoice, you issue it yourself. The seeker's payment to Relieved counts as payment to you. Relieved issues no receipts or invoices in your name unless you separately authorise Relieved in writing to do so, and is not liable for your receipt, invoice and VAT obligations, including the time at which VAT on a prepaid visit becomes due.

Business hosts and private hosts. At present the Platform admits Business Hosts only (Section 1); the provisions on Private Hosts apply once the Platform admits them.

When you register as a host, you tell us whether you act as a business (a 'Business Host', for example a cafe, shop, hotel, or any person acting for purposes relating to their trade, business, craft, or profession) or as a private individual (a 'Private Host', a consumer acting outside any trade or business). This classification determines both how VAT is handled on your payouts and which parts of this Addendum apply to you; it is also shown to seekers on your listing, together with, for Private Hosts, a notice that EU consumer-protection law does not apply to the contract between the seeker and the host. You must keep this classification accurate and update it if your circumstances change. Sections H2 to H9 apply to all hosts. Sections H10 and H12 apply additionally, and only, to Business Hosts. Section H11 protects Private Hosts who act as consumers.

H2. Listing Accuracy, Standards, and Non-Discrimination

You warrant that all listing information (location, facilities, hand washing, soap, paper, opening hours, restrictions, price) is accurate and kept up to date. Your facility must be clean, functional, and adequately supplied whenever listed as available, to a standard appropriate for a toilet accessible to members of the public. You must disclose known hazards.

You must honour every confirmed booking without discrimination, in accordance with Section 16 of the main Terms. Refusing or conditioning access on a discriminatory ground is a material breach of this Addendum.

H3. Legal, Hygiene, and Local Compliance

You are solely responsible for complying with all applicable local, national, and international laws, permits, licences, and hygiene and safety standards in your jurisdiction. Relieved does not verify regulatory compliance and accepts no liability for your failure to comply. Depending on your country, hosting may trigger business-registration, social-security, hygiene, or permit obligations, for example (non-exhaustive): France (BIC income, URSSAF registration and social contributions, Paris changement d'usage); Germany (income tax, possible Gewerbeanmeldung, §19 UStG small-business rules); Spain (IRPF, possible autónomo/RETA registration, community-of-owners rules); Italy (IRPEF, the occasional-activity/INPS threshold, Partita IVA once activity becomes habitual, SCIA/ASL hygiene duties for commercial premises). You are responsible for determining and meeting your own obligations.

Country rules on paid toilet access (commercial premises). If you operate commercial premises (for example a cafe, restaurant, or shop), local law may require you to keep your toilet free of charge for your own paying customers, while paid access for non-customers through Relieved remains permitted. In particular (non-exhaustive): in France, the former national rule reserving toilets for an establishment’s own customers (Arrêté of 9 May 1995, art. 21) was repealed by the Arrêté of 8 October 2013, so it no longer restricts paid access for non-customers; the sanitary requirements of the applicable Règlement Sanitaire Départemental continue to apply, and if you record visit revenue in a computerised cash-register or POS system, that system must meet the certification requirements of Article 286-I-3° bis of the French Tax Code (NF525/LNE certificate or publisher's attestation), and you must give the seeker a note for services of €25 or more, or on request below that amount (Arrêté of 3 October 1983); in Rome/Lazio (Italy), your toilet must remain free for your own clientèle (Rome Regolamento di Polizia Urbana, art. 18) and, where you charge non-customers, the price must be displayed on a clearly visible sign at the premises (Lazio L.R. 22/2019, art. 75(6)); in Spain (Barcelona), paid access for non-customers must be clearly indicated at the premises. Listing on Relieved does not replace or limit these obligations; you must comply with them at all times. In Hungary, offering paid toilet access is not a licensable commercial activity, so your existing hospitality permit is sufficient and no separate notification to the local authority is required; you should, however, add the activity code for toilet operation (ÖVTJ 960902) to your business registration within 15 days, keep the facility compliant with Regulation (EC) No 852/2004 on hygiene, and observe any local closing hours (in District VII of Budapest, business premises must be closed between midnight and 6 a.m. unless they hold a separate night-opening permit). Payments collected online through the Platform do not relieve you of your receipt obligation: you ring up every visit at the code check in your own cash register or e-cash register (pénztárgép / e-pénztárgép) for the visit price, with payment method "egyéb", and hand over the receipt (nyugta); if the visitor asks for an invoice, you issue a (simplified) számla yourself; if you have no cash-register obligation, you issue a manual or computer receipt and report the daily totals to the NAV within three calendar days; you must keep a municipally authenticated customers' book (vásárlók könyve) visibly and freely available at your premises and answer written complaints within 30 days; if you are VAT-registered, your payout account must be a domestic Hungarian business payment account (pénzforgalmi számla); and if you use the KATA scheme, note that KATA requires your income to come from private individuals; the collection structure in Section H1 is designed so that the visit price remains paid to you by the visitor, but you remain solely responsible for your own tax position and should consult your own tax adviser before hosting.

H4. Taxes and DAC7 Reporting

Income you earn through Relieved may be subject to income tax, VAT, and social contributions depending on your jurisdiction. You are solely responsible for declaring and paying all applicable taxes; Relieved does not provide tax advice and does not withhold tax on your behalf unless required by law.

As an online platform, REBA Software is required under EU Directive 2021/514 (DAC7) and its national implementations to collect, verify, and report certain host information (including your identity, tax identification number, the address and, where applicable, the land-registration (cadastral) number of the listed premises, and the income you earn through the Platform) to the Dutch tax authority, which exchanges it with the tax authority of your country. By hosting, you agree to provide the required information. If you do not provide it after a reminder, Relieved may, after giving you notice and a reasonable period to comply and stating its reasons, suspend payouts or the listing concerned until the information is provided; the suspension is lifted as soon as you comply.

H5. Payouts via Stripe Connect

Host payouts are made through Stripe Connect. You must create and maintain a Stripe Express account, accept the Stripe Connected Account Agreement, and provide accurate payout information. Your Stripe account and the Stripe Connected Account Agreement apply to all toilets of your business. Relieved has no control over Stripe's decisions regarding your Stripe account and accepts no liability for payout delays or failures caused by Stripe. Your share of the visit price is paid once a month, normally on the 8th and no later than the 12th, for all visits of the preceding calendar month, on the schedule stated in the app, net of the Relieved platform commission. If your balance stays below a small minimum per currency stated in the app, it is carried into the next month, at the latest until the second monthly round after that; if you stop hosting, your balance up to one week before the round is paid in the next monthly round and the remainder in the round after. With every payout you receive by email a statement of account (our rendering of account as collection agent) listing for each visit the visit price, the commission retained and your share, together with the monthly collective invoice for the platform commission, which is settled by set-off against the payout; objections to a statement are raised within 30 days via finance@relievedapp.com. You agree to receive statements and invoices electronically. The commission is invoiced (a) to hosts established in the Netherlands without VAT for as long as REBA Software applies the Dutch small-business scheme (Section 25 of the Dutch VAT Act), with the applicable exemption mention, and otherwise with 21 percent Dutch VAT, (b) under the reverse-charge mechanism to hosts in another Member State, who provide a valid VAT identification number for that purpose and account for the VAT under their national rules, or (c) where REBA Software applies the EU small-business scheme in your country, with the applicable exemption mention and our EX number, in which case no VAT is due on the commission and you do not apply the reverse charge.

You must hold a valid VAT identification number or, where your national law does not require VAT registration for your business, your national tax number, for as long as you host. Your listing is only visible and bookable while your Stripe connection is active and your VAT or tax number has been verified; if either condition is no longer met, your listing is suspended automatically until it is restored, and you receive a notice by email explaining the reason. Relieved's obligation to pay your visit share is fulfilled once the amount is transferred to your Stripe account; the payout from Stripe to your bank account follows Stripe's own schedule and the Stripe Connected Account Agreement, and where the payout currency differs from the currency of your account's country, Stripe may apply a minimum payout amount and a fee.

The platform commission is invoiced monthly and is normally set off against your payout. Where a commission invoice is separately payable, payment is due within 30 days of the invoice date. Late payment automatically incurs interest at the statutory rate for late payment in commercial transactions under the applicable law, being the European Central Bank refinancing rate plus 10 percentage points where French law applies and plus 8 percentage points where Italian law applies (Legislative Decree 231/2002), as well as the fixed recovery indemnity of 40 euros per unpaid invoice, without prior formal notice. Hosts established in Italy receive commission invoices as cross-border invoices outside the Italian SdI exchange system and, where required, carry out the integration themselves (autofattura, document type TD17). No discount is offered for early payment.

H6. Pricing, Fees, and No Circumvention (Host Side)

You set your own visit price: the amount the seeker pays for a visit, excluding the guest fee. From it, Relieved retains the €0.50 platform commission per visit (or the fixed amount in your toilet's currency, Section 4.3), which we invoice to you monthly (Section H5); the remainder is your share. During registration you may also enter your price as the amount you want to keep per visit; the visit price is then that amount plus the commission, and that is how it is shown to the seeker. The €0.35 guest fee paid by a seeker without a Credit balance is a fee to Relieved and does not affect your visit price. The price confirmed at booking is binding: you may not charge the seeker more than the confirmed price, request additional payment on site, or ask the seeker to pay outside the Platform for a visit initiated through it (Section 16 of the main Terms). The visit price is your turnover; it includes any VAT you owe on it, and you are responsible for that VAT.

H7. Seeker Data and Privacy

You may not collect, store, photograph, or otherwise process seekers' personal data beyond what is necessary for the immediate visit, and you may not use the Platform to gather seeker information for any commercial purpose. Relieved does not share the seeker's identity with you; access is verified through a one-time code. You must comply with the GDPR in respect of any personal data you do handle.

H8. Force Majeure and Availability

If you cannot fulfil bookings (illness, closure, force majeure), you must deactivate your listing promptly. Repeated failure to honour bookings may result in suspension. You are responsible for the acts and omissions of your staff and of any other person you use to perform your obligations, as if they were your own.

H9. Indemnification by Host

You agree to indemnify and hold harmless REBA Software from any claims, damages, losses, or expenses (including legal costs) arising from: the condition or safety of your premises; inaccurate or misleading listing information; your breach of these Terms or the Host Addendum; your failure to comply with law or tax obligations; or any act or omission in connection with a booked visit.

H10. Additional Terms for Business Hosts

This Section H10 applies only where you host as a Business Host (acting for purposes relating to your trade, business, craft, or profession). If you are a Private Host acting as a consumer, this Section does not apply to you and Section H11 applies instead.

Because the relationship between REBA Software and a Business Host is a business-to-business relationship, the following apply:

H11. Private Hosts Acting as Consumers

This Section H11 applies where you host as a Private Host and act as a consumer (outside any trade, business, craft, or profession).

Where you host as a consumer, your mandatory statutory rights as a consumer under the law of your country of residence apply and are not affected or reduced by this Addendum. In particular: any limitation of REBA Software's liability towards you applies only to the extent permitted by the consumer law of your country of residence; the harder business-to-business terms in Section H10 do not apply to you; and you retain the protection of the mandatory consumer-protection and jurisdiction rules described in the main Terms. Nothing in this Addendum requires you to waive a right that your national consumer law does not allow to be waived. You remain responsible for your own tax, registration, and local-law obligations as described in Sections H3 and H4.

Please note: if you host regularly, repeatedly, or in an organised way, you may be treated under national law as acting for purposes relating to a trade or business. In that case you may be re-classified as a Business Host, with the consequences set out in Sections H3, H4, and H10, and you may acquire registration, tax, and social-security obligations in your country.

H12. Transparency for Business Hosts (Regulation (EU) 2019/1150)

This Section H12 applies to Business Hosts and reflects Regulation (EU) 2019/1150 on fairness and transparency for business users of online intermediation services.

H13. Specific Approval of Clauses (Italian Business Hosts)

Where you are a Business Host established in Italy, the following applies in addition. Pursuant to and for the purposes of Articles 1341 and 1342 of the Italian Civil Code, you specifically approve, by way of a separate and express confirmation requested during host onboarding, the following clauses: Section 12 (disclaimer and limitation of liability), Sections 14.2 and 14.3 (termination and immediate suspension), Section 15 (changes to these Terms), Section 20.3 (governing law and jurisdiction), Section H4 (suspension pending tax information), Section H5 (set-off of the commission and payment terms), Section H10 (limitation of liability, suspension for cause, exclusive jurisdiction of the courts of Amsterdam) and Section H12 (changes on 15 days’ notice; restriction, suspension and termination).

H14. Specific Approval of Clauses (Hungarian Business Hosts)

Where you are a Business Host established in Hungary, the following applies in addition. Under Section 6:78(2) and (3) of the Hungarian Civil Code (Act V of 2013), a standard contractual term that differs materially from the law or from usual contractual practice becomes part of the contract only if the other party has been separately informed of it and, after that separate information, has expressly accepted it. Accordingly, by way of a separate and express confirmation requested during host onboarding, and not by acceptance of these Terms as a whole, you expressly accept the following clauses: Section 12 (disclaimer and limitation of liability), Sections 14.2 and 14.3 (termination and immediate suspension), Section 15 (changes to these Terms), Section H4 (suspension pending tax information), Section H5 (set-off of the commission and payment terms), Section H10 (limitation of liability, suspension for cause, exclusive jurisdiction of the courts of Amsterdam) and Section H12 (changes on 15 days’ notice; restriction, suspension and termination).
